Our online store is hosted by Shopify Inc., which provides the e-commerce platform through which certain products and services are offered.

1. Eligibility and Lawful Use

You must be at least the age of majority in your jurisdiction to make purchases, submit publishing applications (18+), enter agreements, or provide payment information through this website.

A parent or legal guardian may use the website and purchase products for a minor.

You agree to use the website only for lawful purposes. You may not use the website to violate any law, infringe intellectual-property rights, transmit malicious software, interfere with website security, collect information about others without authorization, or engage in fraudulent, abusive, misleading, or harmful conduct.

We may restrict or terminate access to the website when we reasonably believe these Terms have been violated.

2. Website Information

We make reasonable efforts to present accurate and current information. However, website content may occasionally contain typographical errors, outdated information, omissions, or technical inaccuracies.

Website content is provided for general informational purposes. We may correct errors, update information, change page content, or discontinue website features without prior notice.

Product availability, formats, specifications, packaging, pricing, and descriptions may change without notice. We may limit quantities, discontinue products, reject transactions, or cancel orders when necessary.

Images are provided for reference. Colors, proportions, finishes, packaging, and other visual details may vary because of device displays, printing methods, production partners, or manufacturing differences.

Nothing on the website guarantees that a particular product, format, edition, or quantity will remain available.

4. Pricing and Payment

Prices are displayed in United States dollars unless otherwise stated.

Applicable taxes, shipping charges, financing charges, or other disclosed costs may be added during checkout. You agree to provide accurate billing, payment, contact, and delivery information.

We may correct pricing errors and cancel or modify an affected transaction. If we cancel a paid order because of our pricing or listing error, we will provide an appropriate refund for the canceled item.

Payment for publishing services is governed by the applicable invoice and signed publishing agreement. Unless otherwise stated in writing, payment for a publishing service is due in full within five calendar days of the invoice date.

Flexible financing may be available to eligible applicants through Affirm or another approved third-party provider. Financing approval, interest, payment schedules, and related terms are determined by the financing provider, not Purple Diamond Press.

5. Order Acceptance and Cancellation

An order confirmation does not necessarily constitute final acceptance of an order. We may decline or cancel an order because of suspected fraud, payment failure, incorrect pricing, inventory limitations, geographic restrictions, production limitations, or other legitimate business reasons.

A physical-product order may be canceled only before it enters production, fulfillment, or shipment. Print-on-demand and personalized products may enter production shortly after an order is placed and may not be cancelable after that point.

If we are unable to ship merchandise within the promised period, applicable law may require us to obtain consent to a revised delivery date or issue a refund for the unshipped merchandise.

6. Shipping and Delivery

Delivery dates are estimates unless expressly guaranteed in writing.

Purple Diamond Press is not responsible for delays caused by carriers, customs processing, severe weather, labor disruptions, address errors, supply interruptions, production partners, or other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. Additional charges caused by an incorrect address, rejected package, or unsuccessful delivery may be your responsibility.

Risk of loss and title to physical products pass as permitted by applicable law and the carrier’s terms.

7. Returns, Exchanges, Store Credit, and Damaged Products

Returns, exchanges, store credit, replacements, and refund eligibility are governed by our separate Refund and Return Policy, which is incorporated into these Terms by reference.

Unless required by law, Purple Diamond Press generally does not issue refunds for physical books or merchandise. Depending on the circumstances, an approved exchange, replacement, or store credit may be offered.

Digital downloads, eBooks, and other immediately accessible digital products are not eligible for return or refund unless required by law.

Apparel and print-on-demand merchandise fulfilled by third-party production partners, including Printful, are generally not eligible for return or exchange for sizing preferences or buyer’s remorse. Defective, damaged, misprinted, or incorrect items will be evaluated under our Refund and Return Policy.

You must inspect an order promptly and report damaged, defective, or incorrect items within the period stated in that policy.

Store policies should clearly explain available remedies and applicable deadlines.

8. Publishing Services

Purple Diamond Press offers selective, author-funded publishing experiences and related professional services.

Information presented on this website about publishing experiences, deliverables, pricing, timelines, distribution, marketing, reviews, author copies, and other benefits is provided for general informational purposes. It does not constitute an offer of publication, publishing agreement, guarantee, or binding commitment.

The specific rights, services, costs, obligations, deliverables, royalties, schedules, termination provisions, and other terms for an accepted project are governed exclusively by the written publishing agreement and any applicable addenda signed by Purple Diamond Press and the author.

If website content conflicts with a signed publishing agreement, the signed publishing agreement controls.

9. Selective Acceptance of Manuscripts

Submission of an application or manuscript does not guarantee acceptance, publication, representation, evaluation beyond the stated review process, or an offer of services.

Purple Diamond Press may accept or decline a manuscript in its discretion based on factors that may include editorial fit, intended readership, content, quality, market positioning, production requirements, strategic fit, scheduling capacity, and alignment with our publishing mission.

Unless otherwise stated, applicants should expect an acceptance or non-acceptance decision by email within approximately 14 days. This timeframe is an estimate and may vary.

A decision not to accept a manuscript does not constitute a statement that the manuscript lacks merit or cannot be published elsewhere.

10. Manuscript Submissions and Confidentiality

You represent that you have the legal right to submit all manuscripts, illustrations, photographs, concepts, sample pages, and related materials you provide.

You must not submit material that infringes another person’s copyright, trademark, privacy, publicity, contractual, or other rights.

Purple Diamond Press receives many submissions. Similarities may exist between independently developed titles, concepts, themes, characters, or ideas. Submission of material does not create an exclusive relationship, fiduciary duty, publishing relationship, or obligation to compensate you.

Purple Diamond Press will use reasonable care when reviewing submitted materials. However, unless a separate written confidentiality agreement has been signed, website submissions are not treated as confidential trade secrets.

Ownership of an applicant’s manuscript remains with the applicant unless and until rights are granted through a separate written agreement.

11. Publishing Fees and Non-Refundability

Publishing services require advance planning, personnel allocation, project scheduling, administration, vendor coordination, and professional labor.

Once publishing services have commenced, payments are non-refundable except where required by law or expressly provided otherwise in the signed publishing agreement.

Services may be considered initiated when Purple Diamond Press begins activities including project setup, scheduling, consultation, manuscript preparation, editor or illustrator coordination, creative matching, metadata development, design, production preparation, distribution administration, marketing preparation, or other project-specific work.

Failure to make a required payment may result in suspension, rescheduling, withholding of deliverables, or termination of services as provided in the publishing agreement.

12. Editing and Illustration

Editing and illustration may be contracted separately from the publishing fee.

Purple Diamond Press may assist authors by providing access to vetted editors and professional illustrators, facilitating introductions, offering creative guidance, and overseeing quality and production compatibility.

Unless expressly stated otherwise in writing, editors and illustrators are independent professionals and are not employees of Purple Diamond Press. Their separate contracts, fees, schedules, deliverables, and payment terms may be governed by agreements directly between the author and the professional.

Purple Diamond Press does not guarantee the availability of any particular editor or illustrator.

13. Distribution

Eligible titles may receive distribution through Independent Publishers Group or other distribution, wholesale, retail, library, educational, or digital channels.

Distribution means that a title may be listed, made available, presented, or offered through applicable trade channels. Distribution does not guarantee that any retailer, bookstore, library, school, museum, wholesaler, or other organization will order, stock, display, promote, or sell the title.

Distribution eligibility, timing, metadata requirements, inventory requirements, formats, territories, and continuation may be subject to distributor policies and the signed publishing agreement.

14. Marketing and Author Participation

Marketing is a shared responsibility.

Purple Diamond Press may provide marketing guidance, promotional materials, website exposure, review submissions, launch recommendations, distribution support, publicity opportunities, or other services specified in an applicable publishing agreement.

Authors are expected to participate actively in promoting their books. Participation may include social media, community outreach, school visits, bookstore events, speaking engagements, interviews, signings, reader engagement, and other appropriate promotional activities.

Purple Diamond Press does not guarantee book sales, bestseller status, media coverage, reviews, awards, retailer placement, event invitations, speaking engagements, audience growth, profitability, or any other commercial result.

15. Reviews, Awards, Media, and Publicity

Payment for, submission to, or eligibility for a review service does not guarantee that a review will be positive, published, completed by a particular date, or accepted for coverage.

Likewise, entry into an award program does not guarantee finalist status, recognition, or an award.

Trade reviews, consumer reviews, award programs, media outlets, retail platforms, distributors, and publicity organizations are independent third parties. Their decisions and editorial judgments are outside our control.

16. Complimentary and Discounted Author Copies

The number of complimentary paperback author copies included with a publishing experience is the total number allocated to that selected experience, not an additional quantity added to copies listed under another tier.

Additional author copies may be available at a discounted author-copy rate. That rate may include printing costs, applicable shipping charges, and a small publisher fee per copy.

Author-copy pricing may vary based on trim size, binding, page count, color specifications, order quantity, production method, freight costs, and delivery destination.

Author copies are intended for the author’s own use and may be subject to additional terms in the publishing agreement.

17. Offset Hardcover Printing

Eligible authors may elect to participate in a separately priced offset hardcover printing program.

Offset printing, premium bindings, special finishes, freight, warehousing, inventory allocation, distributor delivery, and related services are not included in a standard publishing fee unless expressly stated in writing.

All offset-printing projects are governed by a separate written quotation, invoice, addendum, or printing agreement.

Colors, materials, finishes, dimensions, freight costs, production schedules, and manufacturing tolerances may vary. Production does not begin until required approvals and payments are received.

18. Brand to Books™ and Subsidiary Opportunities

Purple Diamond Press may offer optional brand-development, merchandise, licensing, educational, subsidiary-rights, or brand-extension opportunities through Brand to Books™ or another program.

Potential opportunities may include series development, educational resources, activity products, merchandise, audio editions, translation rights, licensing, film or media consideration, speaking opportunities, and strategic partnerships.

Not every title is appropriate for brand extension or subsidiary-rights development. Evaluation, participation, and any resulting terms are determined separately.

No licensing, translation, audio, merchandise, adaptation, media, partnership, or subsidiary-rights outcome is guaranteed.

19. Independent Entities and Partnerships

Purple Diamond Press may support, collaborate with, promote, or link to independent foundations, businesses, literacy initiatives, nonprofits, sponsors, distributors, vendors, and community organizations.

Unless expressly stated otherwise, these organizations are separate legal and operational entities. A collaboration, website reference, logo display, sponsorship, or link does not create a partnership, joint venture, agency relationship, fiduciary relationship, or mutual legal responsibility.

Charity’s Readers for Tomorrow and Purple Diamond Press maintain separate identities, missions, programs, finances, and operations unless a specific written agreement states otherwise.

20. Third-Party Services

The website may use or link to services provided by Shopify, Printful, Affirm, payment processors, distributors, social media platforms, review providers, analytics services, shipping carriers, and other third parties.

Your use of a third-party service may be governed by that provider’s own terms and privacy practices.

Purple Diamond Press does not control and is not responsible for third-party websites, approvals, service interruptions, financing decisions, privacy practices, content, fees, or performance.

A link or reference does not constitute an endorsement unless expressly stated.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

You agree to provide accurate, current, and complete information and to update it when necessary.

We may suspend or terminate accounts associated with fraud, abuse, chargebacks, infringement, unlawful conduct, or violations of these Terms.

22. Reviews, Comments, Testimonials, and Feedback

You may submit reviews, comments, testimonials, photographs, survey responses, or other feedback where permitted.

You retain ownership of your original submission, but you grant Purple Diamond Press a nonexclusive, worldwide, royalty-free license to display, reproduce, edit for length or clarity, and use the submission in connection with our website, publishing activities, advertising, and promotional materials, unless prohibited by law or otherwise agreed in writing.

We will not materially alter the meaning of a testimonial without permission.

You represent that your submission is truthful, based on your genuine experience, and does not infringe another person’s rights.

We may remove content that is unlawful, fraudulent, abusive, defamatory, obscene, misleading, infringing, or otherwise inappropriate.

This section does not apply to manuscript submissions, which are governed by Section 10.

23. Intellectual Property Ownership

The website and its contents—including company branding, page designs, graphics, written copy, photographs, videos, logos, promotional materials, original illustrations, and other protected content—are owned by Purple Diamond Press, its authors, illustrators, licensors, partners, or other respective rights holders.

Nothing on the website transfers ownership or grants a license except as expressly stated.

You may not copy, publish, reproduce, adapt, distribute, sell, sublicense, scrape, create derivative works from, or commercially exploit protected content without prior written authorization from the applicable rights holder.

Individual books, characters, illustrations, author materials, and series may be owned by different parties pursuant to applicable contracts. Inclusion on this website does not imply that Purple Diamond Press owns every displayed work.

Our collection and use of personal information are governed by our separate Privacy Policy, which is incorporated into these Terms by reference.

California law may grant qualifying consumers rights concerning certain personal information collected by businesses.

28. Electronic Communications

By contacting us, submitting an application, opening an account, or making a purchase, you consent to receive transactional electronic communications related to your inquiry, submission, account, order, contract, or project.

Marketing communications are subject to applicable consent and unsubscribe requirements.

Electronic records, signatures, approvals, and communications may be used in connection with website transactions and publishing services to the extent permitted by law.

29. Disclaimer of Warranties

To the fullest extent permitted by law, the website and general website services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Purple Diamond Press and its officers, directors, employees, contractors, agents, licensors, and service providers from third-party claims, losses, liabilities, damages, and reasonable legal expenses arising from:

Your infringement of another party’s rights
Fraudulent, misleading, or harmful conduct attributable to you

This obligation does not apply to the extent a claim results from Purple Diamond Press’s own unlawful conduct.

Separate publishing agreements are terminated only in accordance with their own terms.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Subject to any enforceable dispute-resolution provision in a separate signed agreement, disputes arising solely from these website Terms shall be brought in a court of competent jurisdiction located in Orange County, California.

Nothing in this section prevents either party from seeking appropriate injunctive relief relating to intellectual property, confidentiality, fraud, or unauthorized system access.

34. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted or severed as necessary.

The remaining provisions will continue in effect.

35. No Waiver

Failure to enforce a provision does not waive the right to enforce that provision later.

A waiver is effective only if made in writing by an authorized representative of Purple Diamond Press.

36. Entire Agreement and Order of Control

These Terms, together with the Privacy Policy, Refund and Return Policy, Shipping Policy, and other website policies incorporated by reference, constitute the agreement governing general use of the website.

A signed publishing agreement, addendum, services agreement, vendor agreement, sponsorship agreement, licensing agreement, or other specific written contract governs the subject matter of that contract.

When a specific signed agreement conflicts with these general website Terms, the specific signed agreement controls for the conflicting subject matter.

37. Changes to These Terms

We may revise these Terms to reflect changes in our website, products, services, business practices, technology, or legal obligations.

The updated version will be posted with a revised “Last Updated” date.

Your continued use of the website after an update constitutes acceptance of the revised Terms to the extent permitted by law.

Material changes will not retroactively alter a signed publishing agreement unless the parties agree in writing.
